This presentation took place as a debate between Profs. Goldsmith and Post, focusing on the question "Can-and should-terrestrial law govern cyberspace." Goldsmith argues that activity in cyberspace is undertaken by real people, located in real space, and that the traditional principles governing a sovereign state's authority to regulate activity within and without its borders can, generally speaking, accommodate these new forms of activity. Post, on the other hand, suggests that physically-defined sovereigns are neither legitimate nor efficient sources of rules for conduct in this inherently borderless medium.
