Does an owner of a Web page have the right to prevent other sites from linking to hers? This presentation examines the legalities of this issue in their historical, cultural, and technological context. The evolving nature of site relationships on the Web (from "free linking" to the controversies of "Web framing" to the recent emergence of "link licenses") will be analyzed and analogies made to the development of "access rights" in the laws of real property and of intellectual property. In addition, the use and legal effectiveness of disclaimers (such as, "This site has not granted permission to any other site to link to it and does not endorse the content or the products or services sold on any such site.") will be discussed.
